Terms of Service

1. Acceptance of Terms

By accessing or using KoboBulkStream ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. The Service is operated by an individual developer ("Operator") and is provided free of charge.

2. Description of Service

KoboBulkStream is a web-based tool that provides bulk operations management on top of KoboToolbox. It allows users to perform form management, permissions administration, user management, metadata synchronisation (forms, ownership, and permission assignments — not survey response data), and ownership transfers on their KoboToolbox accounts. KoboBulkStream is not affiliated with, endorsed by, or officially connected to KoboToolbox or the Kobo Foundation.

3. Eligibility

You must have a valid KoboToolbox account to use the Service. By using the Service, you represent that your use complies with KoboToolbox's own terms of service.

4. Your Account and Credentials

You are responsible for maintaining the confidentiality of your KoboBulkStream login credentials and your KoboToolbox API token. You are solely responsible for all activity that occurs under your account. You must notify the Operator immediately of any unauthorised use of your account.

Your KoboToolbox API token is stored encrypted in the Service's database. The Operator does not access your token for any purpose other than executing operations you explicitly request through the Service.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Access or modify KoboToolbox resources you are not authorised to access
• Perform operations that intentionally disrupt, degrade, or overload KoboToolbox's infrastructure
• Attempt to reverse-engineer, decompile, or otherwise extract the Service's source code (noting that the source code is separately available under the AGPL v3 licence)
• Use the Service for any commercial purpose without the Operator's prior written consent

6. No Warranty

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. The Operator makes no warranties regarding the availability, uptime, or reliability of the Service, the accuracy or completeness of any results produced by the Service, the compatibility of the Service with your KoboToolbox configuration, or the fitness of the Service for any particular purpose.

Bulk operations by their nature affect multiple resources simultaneously. You are solely responsible for verifying the results of any bulk operation before relying on them.

7. Limitation of Liability

To the fullest extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of forms, unintended permission changes, or disruption to your KoboToolbox account, arising from your use of or inability to use the Service.

The Operator's total liability for any claim arising out of or relating to these Terms or the Service shall not exceed zero, given the Service is provided free of charge.

8. Data and Privacy

KoboBulkStream does not collect, store, or process survey response data, survey submissions, media files, or any other content hosted on your KoboToolbox server. All such data remains exclusively on the KoboToolbox server you connect to, governed entirely by that server's own infrastructure, location, and data policies. KoboToolbox is offered by multiple independent operators on different infrastructure, and servers may be hosted anywhere in the world depending on which KoboToolbox provider you use. The Operator has no control over, access to, or responsibility for where your KoboToolbox server stores your forms, submissions, or respondent data.

For each form, KoboBulkStream displays only the total number of submissions received. No submission content, response values, or respondent data of any kind is retrieved, displayed, or stored by the Service.

What KoboBulkStream stores on its own infrastructure is limited to the operational metadata necessary to operate the Service on your behalf: your KoboBulkStream account credentials, your encrypted KoboToolbox API token, the KoboToolbox server URL you have connected, and permission/form metadata synchronised for display and bulk-operation purposes (such as form names, owner, and user permission assignments). No survey response content or respondent personal data is ever copied to or retained by KoboBulkStream.

You acknowledge that you are the data controller for any personal data on your KoboToolbox server, and that server's operator is responsible for that data independently of KoboBulkStream. With respect to the limited operational metadata described above, the Operator acts solely as a data processor executing your instructions.

9. Third-Party Services

The Service interacts with KoboToolbox's API on your behalf. The Operator is not responsible for the availability, performance, or behaviour of KoboToolbox or any other third-party service. Changes to KoboToolbox's API may affect the functionality of this Service without notice.

10. Open Source Licence

The source code of KoboBulkStream is licensed under the GNU Affero General Public Licence v3 (AGPL v3). These Terms govern your use of the hosted Service. The AGPL v3 licence governs your rights with respect to the source code. In the event of any conflict between these Terms and the AGPL v3 licence as it pertains to source code rights, the AGPL v3 licence prevails.

11. Modifications to the Service and Terms

The Operator reserves the right to modify, suspend, or discontinue the Service at any time without notice. The Operator may also update these Terms at any time. Continued use of the Service after any modification constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Libya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Libya.
